The following, exploring rights to frozen embryos raises interesting process questions for a mediator. Regardless of one’s understanding of when life begins, how a separated couple may resolve how, when and whether, to become parents lends itself to a facilitated discussion. The conflict presented — a desire to have and raise a child alongside a desire not to have one’s biological child in the world and to necessarily face the decision whether to surrender one’s rights and obligations as a parent — is presented in legal and emotional terms. As mediators, we would offer parties a chance to explore deeply their values, interests and concerns and brain-storm potential outcomes together, rather than as adversaries.
